This Disclaimer applies to PortfoliQa, operated by Portifoliqa L.L.C (the "Service"). It is incorporated by reference into our Terms and Conditions. Capitalized terms not defined here have the meaning given in the Terms.
By using the Service, you acknowledge that you have read, understood, and agree to this Disclaimer.
1. Not financial advice
The Service is provided for informational and educational purposes only. Nothing on or generated by the Service constitutes investment advice, financial advice, trading advice, tax advice, legal advice, or any other form of advice or recommendation.
Portifoliqa is not:
- A registered broker-dealer or licensed broker;
- A registered investment adviser (RIA) under the U.S. Investment Advisers Act of 1940;
- A licensed financial planner, accountant, or attorney;
- A regulated financial institution in Brazil (no registration with the Comissão de Valores Mobiliários — CVM) or any other jurisdiction;
- A fiduciary to any user of the Service.
We are a software company that aggregates publicly available data and produces analytical content. We do not know your financial situation, risk tolerance, tax situation, or investment objectives, and we cannot give you personalized advice.
Always consult a qualified, licensed financial professional before making any investment decision.
2. No solicitation
The Service is not a solicitation, offer, or recommendation to buy, sell, hold, or transact in any security, cryptocurrency, commodity, derivative, or other financial instrument. Information about specific tickers, assets, or markets is not an endorsement of those tickers, assets, or markets.
The Service is intended for users where its provision is lawful. Nothing in the Service should be construed as an offer of financial services in any jurisdiction where such an offer would be unlawful.
3. Third-party data — no warranty
The Service displays data sourced from third parties, including Financial Modeling Prep, Twelve Data, Polygon.io, Yahoo Finance (yfinance), CoinGecko, and DefiLlama. While we work with reputable providers, we do not guarantee the accuracy, completeness, timeliness, or reliability of any data displayed.
- Market prices may be delayed, often by 15 minutes or more.
- Historical data, fundamentals, and corporate-action data may contain errors, gaps, or revisions.
- News content is summarized and may misrepresent or omit material details.
- Data feeds may experience outages, latency, or transmission errors.
Verify any information independently — including with your broker, the issuer's official filings, or the relevant exchange — before relying on it for any decision.
Data attribution and provider terms: market data and content are provided by their respective owners. Polygon.io, FMP, and other providers may require specific attribution language; that attribution is shown on the Service where required by their terms.
4. AI-generated content
Some Service features — including the chat assistant, news summaries, valuation commentary, and scoring narratives — are generated using artificial-intelligence models (currently provided by OpenAI or Groq, depending on configuration).
AI-generated content:
- May contain factual errors, hallucinations, or fabricated citations;
- May not reflect current market events, recent SEC/CVM filings, breaking news, or recent corporate actions;
- May reproduce biases present in the model's training data;
- Is generated probabilistically — re-running the same query may produce different output;
- Should be independently verified before being acted upon.
AI output is not a substitute for human judgment or professional advice. Do not rely on AI-generated content for any investment, tax, legal, or other consequential decision without verifying it with primary sources and qualified professionals.
5. Past performance is not indicative of future results
Any historical performance data, backtests, scores, or indicators displayed on the Service describe past behavior of the underlying assets. Past performance does not guarantee, indicate, or predict future performance. Markets are inherently uncertain. Returns can and do go negative.
Any forward-looking statements, projections, or estimates are inherently speculative and may not come to pass.
6. Risk warnings
All investments involve risk, including the risk of total loss of principal. You should not invest funds you cannot afford to lose.
6.1 Equities and ETFs
Stock and ETF prices fluctuate based on company performance, sector and macro conditions, regulation, geopolitics, and many other factors. Small-cap, illiquid, and emerging-market securities may carry additional risk.
6.2 Cryptocurrency
Cryptocurrencies are highly speculative and volatile. They can lose value rapidly and entirely. Crypto markets operate 24/7 with limited regulatory oversight. Risks include — but are not limited to — extreme volatility, smart-contract bugs, exchange failures, custody loss, regulatory action, fraud, market manipulation, and a complete loss of value. Many crypto-assets have no intrinsic value, no cash flows, and no recourse if the issuer or platform fails.
6.3 Metals and commodities
Metal prices are driven by supply/demand, monetary policy, currency movements, geopolitical events, and other macro factors. Holding physical metals carries additional storage, insurance, and counterparty risks not addressed by the Service.
6.4 Foreign-exchange and cross-border investing
Investing in non-domestic markets (e.g. a US user investing in B3 securities, or a BR user investing in NYSE/NASDAQ securities) carries currency risk, foreign-tax risk, custody risk, settlement risk, and regulatory risk that can materially affect returns.
6.5 Tax
Tax treatment depends on your individual circumstances and may change. The Service does not provide tax advice. Consult a tax professional licensed in your jurisdiction.
7. No fiduciary duty
Your use of the Service does not create any fiduciary, advisory, or trust relationship between you and Portifoliqa. We do not owe you any duty of care, loyalty, suitability, or best execution.
8. No guarantees of availability
We do not guarantee that the Service will be available at any particular time, or that data updates will arrive within any particular timeframe. The Service may be unavailable due to maintenance, third-party outages, or events beyond our control. Do not rely on the Service for time-sensitive decisions.
9. Limitation of liability
Your reliance on any information provided through the Service is at your sole risk. To the maximum extent permitted by law, Portifoliqa is not liable for any losses, damages, or costs — including investment losses — arising from your use of the Service. See §13 (Disclaimers) and §14 (Limitation of liability) of the Terms and Conditions.
This limitation does not apply to liability that cannot be limited under applicable law (including, for Brazilian consumers, mandatory rights under the Código de Defesa do Consumidor).
10. Jurisdiction-specific notes
10.1 United States
Portifoliqa is not registered with the U.S. Securities and Exchange Commission (SEC), the Financial Industry Regulatory Authority (FINRA), the Commodity Futures Trading Commission (CFTC), or any state securities regulator as a broker-dealer, investment adviser, or commodities trading adviser. The Service does not provide personalized investment advice within the meaning of the U.S. Investment Advisers Act of 1940 or the rules of any U.S. state.
10.2 Brazil
